RESPONDING TO THE U.S. CENSUS

Recently I received an inquiry from a person who had received a census questionnaire and then a telephone call advising that failure to respond could lead to a prosecution. The federal law (13 USC §221), provides that a person who refuses or neglects to answer any of the questions on any schedule “shall be fined not more than $100”. Giving a false answer is subject to a find up to $500. The same provision notes that “no person shall be compelled to disclose information relative to his religious beliefs or to membership in a religious body”.

The law has withstood constitutional challenges. Questions relating to population, housing, labor and health do not constitute impermissible invasions of privacy. Nor is it a defense that other persons have failed or refused to answer and not suffered prosecution. The short answer is that failure to answer can lead to a prosecution and that, although the sanction is not significant, the hassle of being prosecuted for an offense that does not afford an arguable defense makes it imprudent to refuse.
