OIL & GAS LEASES

Rising gas and oil prices will encourage exploration for reserves here in Michigan.  Owners of tracts of land may be approached by agents offering Oil and Gas Leases with an overture for allowing exploration.  Memories of Jed Clampett and bubbling crude may cause some owners to forego a thorough review of that document.  As might be expected most such forms are drawn in favor of the driller (lessee).  There are many aspects of a lease which are negotiable.  Aside from the obvious question of how royalties are to be calculated, issues subject to negotiation include how long the lease can be extended if wells are capped, installation and removal of roads and equipment, use of fresh water, storage of brine, depth of pipelines and restoration of disturbed surface areas.  It is not uncommon that such leases allow some or all of the property to be pooled with others in order that fewer wells are necessary to service a particular formation.  How the pooling effects a specific property and the charges to be allocated against gross royalties are items that are treated differently in agreements.  Property owners are best served by seeking a review by an attorney familiar with the Oil and Gas Lease forms.
