REDEMPTION PERIODS

The process of foreclosing on real estate mortgages varies from state to state.  Many of the mortgage lenders foreclosing on Michigan properties are unhappy to learn of the Michigan statutes which afford to the borrowers periods of time following the foreclosure sale to ‘redeem’ the property.  During the redemption period the borrower remains entitled to possession unless the premises are deemed ‘abandoned’.  The redemption period is 6 months.  If the property is more than three acres the redemption period is one year.
 
Some lenders have taken to shortening the period of redemption by declaring the property ‘abandoned’.  The redemption period is reduced to 30 days if it is deemed abandoned.  The statute creates a presumption of abandonment if the lender a) makes a personal inspection, b) posts a notice on the property and sends to the borrower by certified mail a notice that the lender deems the property abandoned; and c) records an affidavit.  The borrower can avoid this presumption by mailing and recording a written affidavit stating that he or she is occupying or intends to occupy the premises.  It is important that the borrower pay close attention to the contents of any notices posted on the property to avoid the loss of the protection afforded by the redemption period.
